IP & technology

Intellectual property (IP) is a key asset for many companies.  Patents, trade marks, copyrights and other IP rights enable companies to gain a competitive edge and determine for a large part their value. It is of utmost importance for a company that its IP rights are exploited and enforced effectively. Adequate protection of IP rights is a key driver for technical and social progress. Equally important for companies is the freedom to operate and compete and to defend themselves against unjust infringement allegations.

The lawyers in the IP & Technology department are seasoned experts in IP law. Our experience relates to patents, know-how and technology transfer, trade secrets, pharmaceutical regulatory disputes, trade marks and advertising, trade names, design rights, plant variety rights, copyright and software, domain names, data protection, internet and e-commerce. The team frequently works together with law firms outside the Netherlands in cross-border IP disputes and transactions.

Our core business is IP litigation. We have extensive experience in representing clients before various national and European courts and institutions, including the Dutch Supreme Court, the Court of Justice and the EUIPO. We have been involved in many prominent and pioneering cases. We frequently conduct complex patent proceedings as well as preliminary relief actions in trade mark and copyright infringement cases.

We also advise our clients on the protection, strategic management and commercialisation of their IP rights, for example by drafting and assisting in negotiations regarding licence, technology transfer, distribution and research and development agreements. Our IP litigation experience gives us a good insight into the potential risks to be covered in a contract.

Our IP & Technology practice group has a particularly strong track record in the fields of pharmaceuticals and life sciences. Since many years, BarentsKrans is one of the few firms in The Netherlands to be instructed in major patent and regulatory matters involving pharmaceuticals and biotechnology. Testimonials reveal that clients are extremely satisfied with the industry-specific expertise of BarentsKrans.
