Rieme-Jan is an experienced Supreme Court litigator, and focuses on complex litigation before the Dutch Supreme Court. His areas of expertise include, in particular, contract law, company law, tort law and damages. He worked for many national and international banks and blue chip companies. Given his vast practical experience as Justice in the Court of Appeal and as a litigator in appeal proceedings, he is often asked as “counsel’s counsel” by other law firms to support them in appeal proceedings and in appeal procedures to follow up after cassation. In addition, Rieme-Jan incidentally litigates and arbitrates as lead counsel in high-end matters of (international) commercial contracts and liability. Before joining BarentsKrans, he was a commercial litigator and counsel in arbitrations at Allen & Overy LLP. Rieme-Jan is considered to be one of the leading authorities in contract law in The Netherlands. He also serves frequently as an arbitrator in national and international ad hoc and institutional arbitrations.

Supreme Court: Delta N.V. and Eneco N.V. v. Dutch State: defending energy companies resisting statutory unbundling of activities (pending case)

Supreme Court: ASMI enquiry (Del Prado Sr v. Hermes, Fursa and VEB): successful litigation leading to a landmark decision on corporate governance protecting listed companies against activist shareholders [HR 9 July 2010, LJN: BM 0976]

Supreme Court: Spyker Cars N.V. v. AFM (Dutch Financial Services authorities): successfully defending Spyker in a leading decision on the law regarding annual accounts (including IAS and IFRS) [HR 24 September 2009, LJN: BG 8790]

Successful litigation or arbitration on behalf of various banks and multinationals in different commercial contract disputes regarding a.o. M&A-contracts (SPA’s), joint ventures, private equity contracts, distribution agreements, telecom contracts, loan agreements, real estate and project development contracts
