The Supreme Court Litigation department is recognized as leading in its field by Chambers and Legal 500. The Corporate Litigation department is well-versed in handling disputes covering Director’s and Shareholder’s Liability and our IP lawyers have contributed to successful multi-jurisdictional patent litigation in the pharmaceutical industry.

Recent examples of our work include: 

  • The Supreme Court Litigation department successfully acted on behalf of Bank of America with regard to the sale of LaSalle Bank, N.A., at the time a subsidiary of Dutch bank ABN-AMRO.
  • The IP department successfully nullified Lundbeck’s patent regarding the blockbuster drug escitalopram and restored regulatory approval for a number of generic pharmaceutical companies, thereby enabling them to market generic medicinal products containing es-citalopram in the Netherlands. These proceedings are closely related to litigation in other European countries and have therefore attracted international attention. 
  • BarentsKrans represented World Point Terminals in litigation with Vitol on the sale of one of the largest tank storage facilities in the Netherlands (USD 170 mln) 
  • BarentsKrans represents Claims Funding International (CFI), a litigation funding company alleging that a group of European companies were victims of price-fixing by KLM, Martinair and Air France (with estimated damages of € 400 million). This is the first case where cartel damages have been incurred on behalf of a large group of plaintiffs across a number of jurisdictions (11). 
  • Our firm's Corporate Department assisted Wells Fargo, N.A., a leading US Bank, with the refinancing of the US subsidiaries of a major Dutch company in the Automotive sector. 
  • We assisted Nortek, Inc., a leading diversified global manufacturer of innovative, branded residential and commercial ventilation, HVAC and home technology convenience and security products, with its acquisition of Ergotron, Inc., a privately held company based in St. Paul, Minnesota, for an aggregate consideration of approximately $280 million on a cash and debt free basis. 
  • BarentsKrans advised the Dutch State on its acquisition of Nederlandse Investeringsbank voor Ontwikkelingslanden N.V. (NIO). NIO gives long term loans to developing countries.
